Government guidance urges contracting parties to behave responsibly in the performance and enforcement of contracts during the Covid-19 crisis.

This follows recent comments from senior judiciary suggesting that the Courts might take an economic protectionist stance in commercial disputes post-Covid.

There appears to be a theme emerging and businesses would be wise to take heed of the direction of travel on this before seeking to rely on the letter of their existing contractual terms.
